Agravated Battery

F.S. 784.045 [Felony Second Degree]

Before you can find a person guilty of Aggravated Battery, the State Attorney's Office must prove the following three elements beyond a reasonable doubt:

  1. Defendant intentionally touch or struck the victim against his/her will, and

  2. Defendant intentionally caused bodily harm to the victim, and

  3. Defendant in committing the battery

    1. intentionally or knowingly caused:

      • great bodily harm to the victim, or
      • permanent disability to the victim, or
      • permanent disfigurement to the victim

    2. used a deadly weapon, and
    3. knew or should have known that the victim was pregnant
