Lewd & Lascivious Molestation

F.S. 800.04(5)(a) [Life Felony]

Before you can find a Defendant guilty of Lewd and Lascivious Molestation, the State Attorney's Office must prove the following two elements beyond a reasonable doubt:

  1. The victim is under sixteen years of age, and

  2. Defendant touches him/her in a lewd and lascivious manner on their breasts, genitals, genital area, or buttocks, or the clothing covering them.

NOTE:
1. The age of the Defendant and the victim impact the potential punishment for the offense. See F.S. 800.04(5)(b),(c)1. and (c)2.
2. A lewd and lascivious molestation charge can be prosecuted by the State Attorney's Office where the victim commits the alleged molestation when enticed to do so by the Defendant.
